# Dark Forge Automation — Terms of Service

## 1. Agreement and eligibility

These Terms govern access to Foundry Community Suite (the “Service”). By installing, purchasing, or using the Service, the customer and authorized users agree to these Terms and Discord's applicable terms and policies. The person ordering the Service represents that they can bind the relevant Discord server owner or organization.

## 2. Service

The Service provides configurable Discord ticketing, onboarding, moderation, self-service roles, logging, hosting, backups, and related support according to the selected order or plan. Features, usage limits, support response targets, and custom work are defined in the applicable order form. Discord is a third-party platform and is not controlled by Provider.

## 3. Customer responsibilities

Customers must configure permissions responsibly, limit administrator access, use moderation lawfully, maintain accurate contact details, and avoid illegal, abusive, deceptive, infringing, or platform-violating use. Customers may not attempt to obtain credentials, bypass access controls, reverse engineer hosted components where prohibited, disrupt the Service, or use it to evade Discord safety systems.

## 4. Fees and payment

Fees, billing frequency, taxes, renewals, and cancellation terms appear in the order. Unless the order states otherwise, setup work begins after payment and recurring managed service renews monthly until cancelled. Past-due service may be suspended after reasonable notice. Paid app capabilities must use payment methods required by Discord where applicable.

## 5. Customer data and privacy

Provider processes identifiers, configuration, ticket, moderation, and operational data only to provide, secure, support, and improve the Service as described in the Privacy Policy. Customers are responsible for notices and lawful authority covering data they instruct the Service to process.

## 6. Intellectual property

Provider retains ownership of the reusable Foundry platform, libraries, tooling, documentation, and improvements. The customer retains its names, logos, content, and customer-supplied materials. Custom deliverable ownership or licensing must be stated in the order; payment alone does not transfer the reusable platform source code.

## 7. Availability, support, and changes

Provider will use commercially reasonable efforts to operate managed service but does not guarantee uninterrupted availability. Maintenance, security work, Discord API changes, outages, and events outside reasonable control may affect operation. Provider may modify the Service to maintain security, compatibility, or legal compliance without materially removing paid functionality during a current term.

## 8. Suspension and termination

Either party may terminate as stated in the order. Provider may suspend or terminate for material breach, nonpayment, security risk, unlawful activity, or platform-policy violations. On termination, access ends and data is handled according to the Privacy Policy and applicable law. Sections intended by their nature to survive will survive.

## 9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” PROVIDER DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PROVIDER DOES NOT CONTROL DISCORD OR GUARANTEE THAT DISCORD WILL MAINTAIN ANY API OR FEATURE.

## 10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROVIDER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, OR GOODWILL. PROVIDER'S AGGREGATE LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED FEES PAID FOR THE SERVICE DURING THE [THREE/SIX/TWELVE] MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow all limitations.

## 11. Indemnification

To the extent permitted by law, the customer will defend and indemnify Provider against third-party claims arising from customer content, instructions, unlawful use, server administration, or breach of these Terms, except to the extent caused by Provider.

## 12. Governing law and disputes

These Terms are governed by the laws of [STATE/COUNTRY], excluding conflict-of-law rules. Courts located in [COUNTY, STATE/COUNTRY] will have exclusive jurisdiction, unless the order includes a valid arbitration provision or applicable law requires otherwise.

## 13. General

Neither party may assign the agreement except in connection with a merger, acquisition, or sale of substantially all relevant assets, or with consent. If a provision is unenforceable, the remainder remains effective. Failure to enforce is not waiver. The order, these Terms, and the Privacy Policy form the entire agreement and control in that order if they conflict.
